Why a Maturity Framework for FOI?
FOIA sets clear statutory requirements, but it doesn’t explain how mature an organisation’s approach is beyond basic compliance. Two authorities might both meet the law, yet one does so through fragile, manual processes while the other operates a resilient, well-governed FOI function.
A maturity framework helps organisations to:
- Move beyond pass/fail compliance thinking
- Understand strengths and weaknesses across FOI disciplines
- Prioritise improvement activity
- Provide assurance to senior leaders, auditors, and regulators
- Demonstrate learning from ICO guidance and decisions
The Five Levels of FOI Maturity
The framework defines five levels of maturity, which can be applied consistently across key FOI domains:
- Level 1 – Initial
FOI handling is ad hoc and reactive, with a high risk of non-compliance and dependency on individuals. - Level 2 – Basic
Minimum legal requirements are generally met, but practice is inconsistent and processes are fragile. - Level 3 – Defined
Clear procedures and guidance are in place, and compliance is broadly reliable. - Level 4 – Managed
FOI activity is proactively governed, monitored, and improved using performance data and learning. - Level 5 – Optimised
FOI is embedded as a core transparency function, aligned to best practice and organisational culture.
The Four Domains of FOI Maturity
The framework assesses maturity across four critical domains of FOI compliance.
1. Handling Requests Within Statutory Deadlines
This domain focuses on how effectively an organisation receives, logs, tracks, and responds to Freedom of Information requests within the 20-working-day statutory timeframe, including appropriate use of extensions.
At higher maturity levels, deadline compliance is actively monitored, risks are escalated early, and near-100% on-time performance is achieved consistently.
2. Exemptions and the Public Interest Test
Applying exemptions correctly—and defending them—is one of the most challenging aspects of FOI.
This domain assesses the quality, consistency, and defensibility of exemption decisions, including how well the public interest test is understood, documented, and applied. Mature organisations use exemptions confidently but sparingly, learning from ICO decisions over time.
3. Skills and Training on Freedom of Information
FOI compliance depends heavily on people, not just process.
This domain looks at whether FOI knowledge is concentrated in a few individuals or distributed across the organisation through structured training, guidance, and ongoing professional development.
At higher maturity levels, FOI capability is resilient, up to date, and recognised as a specialist skill.
4. The Statutory Publication Scheme
A strong publication scheme is both a legal requirement and a practical way to reduce FOI demand.
This domain assesses how complete, accessible, and actively maintained the publication scheme is, and whether it is used strategically to promote transparency and reduce avoidable requests.
